Puerto Rico rep's fundraising under scrutiny

Pedro Pierluisi, resident commissioner for Puerto Rico and a leading gubernatorial candidate this November, is under scrutiny over his fundraising from campaign finance officials in Washington and San Juan.The Federal Election Commission wants Pierluisi to return more than $91,000 in general election donations to his federal campaign. Since Pierluisi is retiring from his nonvoting position in Congress to run for governor, the FEC said, there is no need for him to retain those funds.The Office of Electoral Comptroller in San Juan, which oversees campaign fundraising for the island territory, has also begun an investigation into Pierluisi’s gubernatorial campaign, specifically whether he raised money from Wall Street executives and lobbyists for the governor’s race without reporting it.Pierluisi has denied any wrongdoing, and his aides say the former attorney general of Puerto Rico has strictly adhered to federal and territory campaign laws. They note the complaint against him was filed by Pierluisi’s opponents and say the August 2014 fundraiser was for his federal campaign, not his gubernatorial committee. Pierluisi was allowed to create an exploratory committee and raise hundreds of thousands of dollars for his gubernatorial run even while not a formal candidate because this is allowed by the law in Puerto Rico.Yet the controversy over his fundraising — and negative publicity over his personal finances, including his wife's consulting work — shows the difficult challenge Pierluisi faces in winning the gubernatorial race even as the territory's government slides closer to default on its $70 billion debt. Pierluisi has been deeply involved in bipartisan congressional talks to help resolve the debt crisis, which so far have yielded no action. The government of Puerto Rico missed a $422 million bond payment on Monday, though a July deadline is seen as more critical.Pierluisi faces a June 5 primary for his party's nomination against Ricardo "Ricky" Rossello, son of former two-term Gov. Pedro Rossello.The probe by the Electoral Comptroller Manuel Torres Nieves began after a complaint by Pierluisi’s political opponents alleged that the New Progressive Party leader improperly took part in a fundraiser with an executive at Wall Street giant Morgan Stanley and other financial industry officials in August 2014. Morgan Stanley had helped the government of Puerto Rico issue $3.5 billion in bonds several months earlier.An invitation obtained by The New York Times said the event would allow Pierluisi “to continue the dialogue with the investment community.” Pierluisi, who had publicly announced his intention to run for governor by the time of the fundraiser, had recently introduced legislation that would change the way the financially beleaguered government could file for Chapter 9 bankruptcy. Two of the clients of the consulting firm that employed María-Elena Carrión, Pierluisi’s wife, would also have benefited from that legislation, the Times reported.In addition, Torres Nieves, the electoral comptroller, is looking into whether Pierluisi was allowed to raise money for his gubernatorial campaign as he was also accepting funds for his federal committee for resident commissioner.In July 2014, Pierluisi declared that he would enter the 2016 gubernatorial race and created a campaign committee. He filed paperwork with the electoral comptroller’s office in San Juan and started raising money for it at that time, but he did not formally declare his candidacy for governor until Dec. 1, 2015, according to his aides.When asked whether he could raise money for both races simultaneously — both posts are up for grabs this November — Torres Nieves declined to answer.“The premise of this question is a fundamental part of the evaluation the auditing division is investigating, so we cannot reach a conclusion before knowing the contents of the final report,” Torres Nieves said in response to an emailed question from POLITICO. Torres Nieves said he hoped to finish his probe by the June 5 primary.From Aug. 1, 2014, to Dec. 1, 2015, Pierluisi’s gubernatorial committee took in more than $774,000, according to data from the electoral comptroller’s office.During this same period, Pierluisi raised more than $117,000 for his federal campaign committee, “Comite Pierluisi,” FEC records show.According to Torres Nieves, Pierluisi was a gubernatorial candidate when he “registered his campaign committee as a candidate to the governorship for the 2016 elections on August 12, 2014.”In the campaign filing with the electoral comptroller’s office in July 2014, Pierluisi said he was a candidate for “governor.” Guidance issued by Torres Nieves’ office in January 2014 states that candidates seeking to create an exploratory committee — and not formally declare for governor — should respond “undetermined” when asked what office they were seeking. Some of Pierluisi’s opponents did just that.Pierluisi aides, including his campaign manager, insisted that Pierluisi was not a formal candidate until December 2015. These aides said all donations made to his federal campaign committee were prior to that date, and there was no overlap between when he was a formal gubernatorial candidate and any federal donations.“Under applicable Puerto Rico law and regulations, individuals do not become candidates until they file the required documents with the Puerto Rico State Elections Commission and the PRSEC officially certifies the candidacy,” said Dennise Perez-Rodriguez, Pierluisi’s spokeswoman. “Mr. Pierluisi filed his intention to run for governor on Dec. 1, 2015, and was officially certified as a candidate by the PRSEC on Jan. 28, 2016.”Perez-Rodriguez added: “Act 222 [of Puerto Rico law] requires that all political fundraising be carried out via committees that must be registered with the Puerto Rico Electoral Comptroller’s Office. Moreover, under Act 222, individuals may register a local exploratory campaign committee, request, raise and spend collected political donations prior to filing their candidacy intention, thus prior to being officially certified as candidates by the PRSEC. On July 2014, Pierluisi registered his local exploratory committee.”Perez-Rodriguez said it doesn’t matter that Pierluisi declared with the electoral comptroller’s office in July 2014 — 16 months earlier — that he was running for governor. Pierluisi couldn’t file with the state elections commission before Dec. 1, 2015 that he was running for governor because the filing period hadn’t opened, but he did so once it did on that date, Perez-Rodriguez said.“The selection of the ‘governor’ alternative when filing a campaign committee at the [OEC] does not determine whether the committee is an exploratory committee; individuals may, in fact, create gubernatorial exploratory committees,” Perez-Rodriguez said.Pierluisi has never officially declared that he is retiring as resident commissioner, the title given to Puerto Rico’s nonvoting representative in Congress, though several candidates are jockeying to replace him.Perez-Rodriguez said Pierluisi’s federal campaign is seeking more information from the FEC on why it is being told to return the general election contributions.“As with all other matters before the FEC, we are in constant communication with FEC personnel to discuss their findings in order to assure that our campaign committee complies with all applicable rules and regulations,” Perez-Rodriguez said. “On this particular matter, we have requested additional information from the FEC in order to resolve the findings set forth in the referenced letter.”
